SERVICES COVERED:Attorney shall provide legal services for indigent defendants in the following category of cases:a. defendants in criminal cases;b. respondents in juvenile matters;c. respondents in extradition proceedings;d. probationers in review or revocation proceeding in matters covered under paragraphs a and b above;e. respondents in mental health proceedings;f. respondents in contempt proceedings;g. parents or child in CHINS (Children in Need of Services);h. by attending required staffing/hearings in problem-solving court matters.REPRESENTATIONAttorney shall provide necessary representation of each indigent defendant assigned at all stages of the proceedings until completed.This includes preparation of all pleadings, documents, letters, research, investigation and any and all activities regarded as adequate representation.Attorney shall use his or her best skill, knowledge, experience and judgment in representing each client.Attorney shall cooperate with appellate counsel in the identification of appellate issues and the identification of matters which may not clearly appear in the record.The caseload of Attorney shall be maintained in accordance with the standard set for in paragraph H of the Comprehensive Plan for Indigent Defense Services in Grant County and the requirements of the Indiana Rules of Professional Conduct.Attorney agrees to regulate his or her private practice to minimize the likelihood of conflicts of interest and situation where Attorneys caseload will lead to the furnishing of representation lacking in quality or to the breach of professional obligations.The legal services set forth in this contract are to be performed by the Attorney named in this contract and substitution of counsel will not occur without prior approval.INTERVIEW SCHEDULE/CLIENT COMMUNICATIONAttorney shall use due diligence in interviewing/meeting with his or her clients as well as communicating with clients.The attorney shall make all reasonable efforts to remain in contact with his clients and shall comply with the Standards and Guidelines of the Indiana Public Defender Commission and Indiana Rules of Professional Conduct.CONFLICTS OF INTERESTIf at any time after an appointment has been made, Attorney discovers a conflict of interest pursuant to the Indiana Rules of Professional Conduct, Attorney shall promptly notify the Board and/or the Managing Public Defender.CONTRACT DURATIONThe duration of the contract shall be for one (1) year. See also Paragraph 10.PAYMENT OF SERVICES AND EXPENSESAttorney shall be paid at the rate determined and funded by the Grant County Council for the calendar year.Attorney shall be paid at least the minimum amount as set by the Indiana Public Defender Commission under the rules set for the reimbursement program.Attorney shall not receive compensation in any other form, from or on behalf of person represented pursuant to this contract.RECORD KEEPING AND REPORTINGAttorney shall maintain individual case records/files showing services provided.The records shall include types of cases, number of charges, and number of defendants.Such records shall be available for inspection by the Grant County Public Defender Board and/or the Managing Public Defender, or the Indiana Public Defender Commission upon request.Said records shall be maintained for at the minimum of the length of time of any executed sentence a defendant receives.These records may be digitally retained/stored with a digital backup in accordance with rules promulgated by the Indiana Supreme Court.CONTINUING LEGAL EDUCATIONAttorney shall attend six (6) hours of continuing legal education during the calendar year.Attorney will meet the standards set forth by the Indiana Public Defender Commission for Grant County to seek reimburseme t of indigent defense services.NOTICESAll notices to Attorney regarding this contract shall be made to the following address: 1005 N. Western Avenue Marion, IN 46952CONTRACT MODIFICATIONAny modification of the contract shall be in writing and approved by all parties.There are no parole agreements accompanying the contract.This is an annual contract and shall automatically renew annually unless either party elects to terminate same and provides termination notice or written resignation on or before October 1st.However, either party may terminate this contract on thirty (30) days notice.TERMINATION OF CONTRACTAny party may terminate the contract for good cause
