Procurement Services assists the academic, research and student community in the acquisition of equipment, goods and services in accordance with university policy and the procurement laws and regulations of the Commonwealth of Massachusetts. The successful candidate will be staff member that can work in a team environment to help meet the mission of the Procurement Services Office in serving and supporting our racially and ethnically diverse campus community.
The Assistant Director will draft, negotiate, and manage the university's contractual agreements with suppliers and other agencies/entities; provide contracting guidance and technical support to university departments; develop specialized contract vehicles and techniques to accomplish university business goals and objectives; analyze and develop provisions, terms and conditions to ensure compliance with appropriate laws, regulations, and internal policies; Integrate diversity, equity and inclusion values into all business operations related to contracting.
Supervision Received: Assistant Vice President for Finance, Procurement Services and Contracting
This position is located on campus in Bridgewater, MA. This position may be eligible for hybrid / remote work in accordance with BSU remote work policy.
This position is an exempt, APA unit position and is subject to the terms of that union agreement.
Essential Duties:
1. Responsible for preparation, review, analysis of potential risks, and negotiation of contractual agreements with suppliers and other agencies/entities, including but not limited to memorandums of understanding, student internship/clinical agreements, and revenue contracts, in accordance with university policy, state and federal laws and regulations.
2. Design and manage the university's contract lifecycle; manage/track key contract dates and incentives, communicate to the user department, manage all activities within contracting module of institutional procure-to-pay solution including integration with Adobe Sign; maintain electronic contract files and records in accordance with M.G.L.
3. Manage contract intake process through execution by authorized signatory, ensure compliance with University Contract Authorization Policy and Procedures.
4. Identify contracts that fall within the GASB 87 Lease Standard and GASB 96 Subscription Based IT arrangements, negotiate favorable terms.
5. Design and oversee post-award contract management activities, including closeout; collaborate with external departments and sourcing lead to ensure timely review of departmental needs prior to contract expiration.
6. Oversee portions of procurement process pertaining to contracting, and work with department leadership to ensure racial equity and social justice is part of the sourcing, supplier onboarding, and contracting procedures.
7. Provide contracting support to review and prepare RFX documents.
8. Analyzes significant and/or unique contract requirements, special provisions, terms, and conditions to ensure compliance with appropriate laws, regulations, and university policies and procedures, draft addenda and communicates results to the AVP and appropriate personnel.
9. Assists the AVP with the development of institutional negotiation strategy for complex contractual issues and leads these initiatives at the AVP's request.
10. Analyzes new law, regulation, and contract trends for potential impact on departmental and institutional goals and objectives.
11. Provides guidance to department and institutional personnel on goals and objectives relating to contracting activities.
12. Prepare quarterly Board of Trustees contracts report for AVP; Conduct periodic reporting of contracting activities as required.
13. Responsible for updates/changes to contract boiler plates, drafting new contract documents, and conformance for web accessibility.
14. Perform other duties as requested.

Required Qualifications:

Preferred Qualifications:
• Master's degree in business administration or public administration, or related field
• Ability to draft moderate to complex, non-routine contractual instruments
• MCPPO designation
• Previous public sector contracting experience
• Experience with eProcurement and/or contracting modules (i.e. Jaggaer)
• Experience with Banner Finance ERP
• Advanced knowledge of contracting concepts and public contract acquisition law and regulations
