  Job Description

  MassDEP's Wetlands Program, within the Bureau of Water Resources, is seeking an environmental professional to join our team. The Wetlands Program administers the Wetlands Protection Act regulations (310 CMR 10.00) and Water Quality Certification (314 CMR 9.00) regulations. As our new Environmental Analyst III (EAIII), you will work within the Major Projects and Policy Unit (MPPU) with three main areas of responsibility:

  • Coordinate MassDEP's §401 Water Quality Certification (401WQC) process and participation in the Federal Energy Regulatory Commission's (FERC) relicensing for Massachusetts hydroelectric facilities, which are an important component of the state's clean energy portfolio. In the 401WQC process, MassDEP determines whether there is reasonable assurance that a federally licensed hydroelectric facility will be operated in a way that does not violate Massachusetts Surface Water Quality Standards (314 CMR 4.00). This responsibility includes significant internal and external consultation; 401WQC application review, permitting, and compliance; and coordinating development and implementation of guidance and regulatory updates.

  • Coordinate policy development and wetlands permitting process for other types of renewable energy (e.g, solar), and support the Wetlands Program Dredge Unit in permitting off-shore wind, as needed.

  • Support project review, permitting, and compliance under the Wetlands Protection Act and 401WQC regulations for the Unit's portfolio, including Wetlands and 401WQC Variances, climate resilience/ecological restoration projects, and multi-town/statewide utility/infrastructure projects.

  This position is based in MassDEP's Boston Office; however, a hybrid schedule may be offered. Field work and in-person meetings are expected.

  Your essential job duties will include (these are not all-inclusive):

  The Environmental Analyst will receive supervision from the Wetlands Engineer (EAIV) and work in coordination with the MPPU Supervisor and Program Chief.

  1. Coordinate MassDEP's 401WQC hydroelectric facility permitting process, participation in the federal relicensing process as appropriate, and updates to related guidance/regulation.

  • Coordinate multi-level internal and external consultation efforts to support all aspects of 401WQC permitting and guidance/regulatory updates

  o Internal team coordination meetings, collaboration to resolve permitting/regulatory issues, briefings, etc. across MassDEP Programs (e.g., Watershed Protection Program (WPP), Office of General Counsel (OGC)) and Regional Offices.

  o Interagency consultation with relevant state (e.g., Department of Fish and Game, Department of Conservation and Recreation, Executive Office of Energy and Environmental Affairs) and federal (e.g., FERC, US Fish and Wildlife, National Park Service) entities.

  o Represent MassDEP at other hydroelectric-related meetings, as needed.

  • Lead 401WQC process during pre-application, application review, permitting, and post-permitting phases

  o Conduct pre-application consultation with applicant, serve as lead reviewer.

  o Prepare 401WQC for internal review and possible public comment, including drafting application-specific conditions and related documentation.

  o Coordinate associated stakeholder and public processes including conducting public hearings/information sessions, reviewing public comments, and preparing draft responses.

  o Oversee the portfolio of projects already certified. Coordinate assessment of compliance with 401WQC conditions and applicable laws and regulations through site inspections, and review of other information. Develop corrective measures, as appropriate.

  o Assist in administrative appeals as necessary, including participating in settlement negotiations, as needed.

  • Coordinate development and implementation of guidance and regulation to establish/clarify procedural and substantive requirements for 401WQC of hydroelectric facilities. This includes scoping and drafting, internal and external coordination, stakeholder / public engagement, guidance issuance process, formal regulation promulgation process, and post-issuance outreach.

  • Coordinate other efforts related to hydroelectric 401WQC

  o Track FERC's federal relicensing process for Massachusetts hydroelectric facilities to identify projects requiring MassDEP's attention or action, such as compliance monitoring for existing 401WQCs.

  o Research other states' hydroelectric certification processes and regulations, as needed.

  o Develop internal workflows for streamlining internal coordination and review.

  o Maintain internal shared document system to ensure project materials are current

  2. Assist MassDEP's efforts to develop and implement wetlands policy and guidance for solar facilities siting, with consideration of the Department of Energy Resources (DOER) SMART program, solar siting maps and other relevant information. Provide support to the regions and stakeholders on wetlands permitting of solar facilities and other types of renewable energy as appropriate. Develop outreach materials and provide training on related topics.

  3. Support project review and permitting focusing on multi-town/statewide infrastructure projects (e.g., renewable energy and utilities).

  • Assist with project review during planning, design, permitting, construction, and post-construction to ensure compliance with applicable provisions of the Wetlands and 401WQC regulations.

  o Coordinate with / provide guidance to project applicants and their consultants, local, state, and federal entities, and the public during all phases of the permitting process, including pre- and post-permitting activities.

  o Assist with draft and final permit documents including application-specific special conditions and other documentation.

  o Support assessment of compliance with permit conditions and applicable laws and regulations through site inspections, and review of other information. Develop enforcement actions and/or corrective measures, as appropriate.

  o Assist in administrative appeals and litigation as necessary.

  4. Other duties, as assigned. This may include assisting with management of contractors/consultants, supporting other programmatic/operational/administrative priorities (e.g., technical/advisory groups, grant application/implementation, procurement processes), collaborating with other MassDEP Programs as needed, and developing and delivering presentations at various venues.

  The successful applicant will have:

  1. Knowledge of policy, regulations, and case implementation related to wetlands and river processes. Direct experience with Massachusetts Federal and Massachusetts Clean Waters Act (MGL C. 21, sec 27), 401 Water Quality Certification Regulations (314 CMR 9.00), Massachusetts Surface Water Quality Standards (314 CMR 4.00), Wetlands Protection Act (MGL C. 131, sec 40), and WPA Regulations (310 CMR 10.00) is preferred.

  2. Experience with the federal relicensing and/or state certification of hydroelectric facilities, and DOER SMART program or other aspects of solar energy is preferred.

  3. Experience developing or reviewing regulatory, policy, and/or guidance documents is preferred.

  4. Experience with construction projects during planning, design, and construction phases, such as developing and/or reviewing technical submittals and environmental permits.

  5. Experience using ArcMap, ArcGIS Online, ArcGIS Pro and other GIS-related tools. Experience using MassGIS data layers is preferred.

  6. Ability to communicate effectively in written/oral forms with internal and external audiences, including professional correspondence, policy and technical report drafting and editing, and presentation preparation and delivery.

  7. Ability to analyze complex data and information, draw conclusions, and summarize effectively for different audiences.

  8. Ability to exercise tactful negotiation and problem-solving skills to resolve issues with internal and external parties.

  9. Knowledge of the principles, practices, and tools of project management and ability to successfully multi-task.

  10. Proficiency with Microsoft Office suite and on-line communication and collaboration platforms (e.g., Microsoft Teams, Zoom, etc.).

  11. Based on assignment, a valid driver's license may be required.

  Qualifications

   First consideration will be given to those applicants that apply within the first 14 days.

  MINIMUM ENTRANCE REQUIREMENTS: Applicants must have at least (A) four years of full-time, or equivalent part-time, technical or professional experience in the field of environmental science, biology, chemistry, earth science, environmental health, meteorology, natural science, toxicology or public health, of which (B) at least two years must have been in a professional capacity, or (C) any equivalent combination of the required experience and the substitutions below.

  Substitutions:

  I. An Associate's degree with a major in the field of environmental science, biology, chemistry, earth science, environmental health, meteorology,. natural science, toxicology or public health may be substituted for a maximum of one year of the required (A) experience.

  II. A Bachelor's degree with a major in the field of environmental science, biology, chemistry, earth science, environmental health, meteorology, natural science, toxicology or public health may be substituted for a maximum of two years of the required (A) experience.

  III. A Graduate degree with a major in the field of environmental science, biology, chemistry, earth science, environmental health, meteorology, natural science, toxicology or public health may be substituted for a maximum of three years of the required (A) experience and one year of the required (B) experience.

  Education toward such a degree will be prorated on the basis of the proportion of the requirements actually completed.

  NOTE: Educational substitutions will only be permitted for a maximum of one year of the required (B) experience.
