Summary
The Department of Human Services (DHS) Administrative Law Judge is responsible for conducting hearings and rendering final, official decisions/opinions subject to judicial review under the Arkansas Administrative Procedure Act. This position is governed by state and federal law and agency/institution policy.
Functions
Supervises a small administrative support staff by interviewing, recommending for hire, assigning and reviewing work, approving leave requests and evaluating the performance of incumbents. Reviews cases by reading files and pre-hearing legal briefs, conducting legal research, conducting pre-hearing conferences with legal representatives of both parties to further define issues, and providing legal advice to Administrative Review Officers. Presides over public and non-public hearings by administering oaths, hearing testimony of witnesses, questioning witnesses, determining admissibility of documentary and testimonial evidence, resolving conflicting testimony and credibility issues, hearing argument of attorneys and witnesses, resolving procedural questions, reading legal and administrative documents and ruling on motions and objections, including pre-hearing and post-hearing motions. Grants or denies postponements and continuances based on facts presented and need for additional information. Reviews information presented in the hearing and post-hearing briefs and issues official Opinions or decisions explaining facts of case (Findings of Fact), applicable laws, (Conclusions of Law), reason for decision (Analysis), and decision reached. Reviews and certifies hearing transcripts and hearing record for appeals to court. Attends legal seminars and conferences and reads legal, technical, and professional publications to continue legal education as required by law. Performs other duties as assigned.

Knowledge, Skills and Abilities
Knowledge of due process laws and procedures, including codes of judicial ethics. Knowledge of laws, regulations, & precedents applicable to specific type of hearing. Knowledge of agency policies and procedures applicable to specific type of hearing. Ability to conduct legal research and give legal advice. Ability to preside over hearings. Ability to write official opinions and decisions.
Minimum Qualifications
Five years experience in the practice of law. Must be licensed to practice law by the State Board of Law Examiners as established by Act 361 of 1917 and Act 88 of 1873. Additional requirements determined by the agency for recruiting purposes require review and approval by the Office of Personnel Management.
