Data protection is at the heart of NetApp: the global regulation of data privacy and security is rapidly evolving, as is the cybersecurity threat landscape, and NetApp continues to invest in a comprehensive Data Protection Compliance Program to manage increasing data privacy and security risks. This role offers the opportunity to help NetApp to deliver and maintain a robust compliance program, as well as innovative product solutions, to support both our business and our customers in the drive to ensure data privacy and security.
The Legal Department plays a critical role within the NetApp organisation. The Legal Team provides front-line guidance and support to all areas of the company, contributing to decisions that impact NetApp's growth and success every day.
Our small - but rapidly growing! - Data Protection team supports NetApp on a cross-functional basis, first and foremost to ensure privacy and security compliance, but also serving as a valued partner and trusted expert adviser to internal clients. We help to enable delivery of business goals, whilst appropriately managing and mitigating data protection related legal, regulatory and reputational risk.
Our team deals with a wide range of issues including working closely with our key stakeholders to ensure that Privacy by Design and appropriate security controls are incorporated into the design of exciting new products for our customers, providing subject matter expertise in relation to customer, vendor/supplier, partner and intra-group contract negotiations, liaising with data protection authorities, and dealing with new and rapidly changing legal and regulatory requirements on a global basis. Your role will require the management and support of a wide range of data protection related matters, as well as providing day-to-day pragmatic legal advice to our Legal Team colleagues and to our critical business partners.
We are looking for a Legal Counsel to support these global privacy and security compliance efforts. This role reports to our Legal Director, Data Protection, and whilst the role is global, addressing privacy and data protection issues in all regions in which we operate (US & Canada, EMEA, APAC and LATAM), as our International Headquarters and main establishment are located in Cork, Ireland, our preference is that you are qualified and based in Ireland.
Your Role
Support and partner with key internal stakeholders to execute NetApp's privacy and security strategy across our organisation to deliver NetApp's business objectives, and collaborate in the design and ongoing update of associated public-facing policies, standards and procedures.Draft, review and negotiate a broad range of data protection provisions within commercial contracts, data processing agreements and other associated documents relating to NetApp's various business activities.Assist with the review, negotiation and implementation of the privacy and security aspects of strategic commercial contracts.Conduct and/or review privacy risk assessments, Transfer Impact Assessments and Data Protection Impact Assessments, ensuring global data transfer and export compliance.Work closely with internal product, engineering and security teams and other key stakeholders to ensure that NetApp products and services are compliant in all of the jurisdictions in which NetApp operates, including supporting the incorporation of Privacy by Design in the end-to-end lifecycle of new products and services.Participate in the development, implementation, and ongoing compliance monitoring of third-party vendors/suppliers and partners to ensure data protection requirements and responsibilities are addressed and appropriately managed.Advise and support engagement with data subjects to ensure that data subjects' rights are appropriately upheld, including support of Data Subject Access Requests.Support NetApp's international AI strategy, advising on evolving regulation and risks and recommending updates to our usage and compliance program.Provide training and education on data protection regulation/legislation and promote a privacy and security focused culture throughout NetApp.Monitor global changes in the technology industry, particularly in privacy and security legislation, carry out analyses of the impact to NetApp and provide guidance in the identification of global compliance risks, implementation, and maintenance of organisational privacy and security compliance processes and procedures in coordination with our Security Team and other internal stakeholders, including the Legal Team.Support engagement with Data Protection Authorities, including in relation to complaints and disputes, if required.
Required Experience
Qualified lawyer with at least 8+ years post-qualification experience, including substantial time working in the technology sector. Ideally you will have a strong background working in or advising technology companies on responsible uses of data, privacy and security risk assessment and mitigation, and privacy best practices.In-depth knowledge of GDPR and other relevant data protection laws and regulations in EMEA. Familiarity with and recent experience of US privacy laws, including CCPA/CPRA, is a distinct advantage. Knowledge and understanding of APAC and/or LATAM privacy laws also desirable.CIPP/CIPM or similar privacy qualification preferred, but not essential.

Team player, able to collaborate, negotiate, influence and solve problems with Legal colleagues, business partners and expert internal and external teams on a cross-functional and multi-level basis.Strong organisational, analytical and critical thinking skills, with strong attention to detail and accuracy.Desire and ability to quickly learn about the activities and specifics of NetApp's business, our advanced technology capabilities, and evolving regulatory environment.Ability to work in a fast-paced environment, prioritising conflicting demands and priorities from multiple stakeholders, and making sound decisions under pressure.Flexibility and enthusiasm, and a willingness to roll up your sleeves and take responsibility to resolve issues.Experience working on IT Security issues would be helpful.Excellent written, presentation and interpersonal communication skills.Fluent English.Cork, Ireland is the preferred location.
